Accepting the Terms
These Terms of Service (“Terms”) are a legal agreement between Wildfire Interactive Limited and its affiliate company (“Wildfire” or “we”) and you (“user” or “you”). By using or accessing any Wildfire game or application (“Service”), you agree to be bound by these Terms. By accessing or using the Service, you affirm that you have read, understood, and accepted to be bound by the Terms. Wildfire reserves the right, in its sole discretion, to modify or revise these Terms at any time, and you agree to be bound by such modifications or revisions. If you do not agree to the Terms, please do not use the Service.
Users are responsible for periodically reviewing the Terms. Your continued use of the Service after changes or updates have been made will constitute your acceptance of the revised Terms. If you do not agree to the Terms, your only recourse is to discontinue your use of the Service and cancel any accounts you have created using the Service.
If you violate the Terms, Wildfire reserves the right to issue a warning regarding the violation or to immediately terminate or suspend any or all accounts you have created using the Service. You agree that Wildfire is not obligated to provide you with notice before terminating or suspending your account(s), but it may choose to do so.
In case of violation of the Terms or other rules of Wildfire, Wildfire reserves the right to deny any user access to the Services without notice. You agree that Wildfire may discontinue the Service or change its content at any time, for any valid reason, with or without notice to you, and without liability.
You represent that you are 13 years old or older. If you are between the ages of 13 and 18, you represent that your legal guardian has reviewed and agrees to these Terms.
Intellectual Property/Ownership
All content comprising the Service (including, but not limited to, designs, text, graphics, pictures, video, information, applications, software, music, sound, and other files, as well as their arrangement) is legally protected against unauthorized use.
The entire content of the Service is safeguarded under the copyright laws of the Hong Kong Special Administrative Region, China, and applicable laws in other jurisdictions.
You agree that no part of the Service’s content may be altered, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in whole or in part, or otherwise exploited without the express prior written permission of Wildfire, except for your own User Content (as defined below) that you lawfully post on the Site. Any other use of copyrighted material, including derivative works, requires Wildfire’s express prior written consent. Unauthorized reproduction or redistribution of materials contrary to these Terms is expressly prohibited and may result in severe civil and criminal penalties.
Wildfire and/or its licensors retain all rights, title, and interest, including copyrights and other intellectual property rights, in all materials posted on the Services by Wildfire. By using the Service or accessing any materials posted on it by Wildfire or any derivative works thereof, you acknowledge that you do not acquire any ownership rights.
Wildfire grants you a personal, non-exclusive, non-transferable, revocable, limited license to use the Service solely for viewing and utilizing the applicable Services and for no other purpose. Your use of the Services is subject to these Terms.
Virtual Currencies/Goods
Wildfire’s Service may provide you with the opportunity to purchase virtual, in-game currency (“Virtual Currency”), which requires the payment of real money. This Virtual Currency cannot be exchanged for real-world money, goods, or any other item of monetary value from Wildfire or any third party.
Purchases of Virtual Currency are final, non-refundable, non-exchangeable, and non-transferable, except at Wildfire’s sole discretion. Any attempts to buy, sell, or exchange Virtual Currency outside the Service or via platforms not designated by Wildfire violate the Terms and may lead to the termination of your account or legal consequences.
Wildfire reserves the right to modify, control, or remove the type, nature, or value of Virtual goods at its sole discretion. Prices and availability of virtual goods within the game may change without prior notice.
To offer more flexible payment options, Wildfire may provide access to a variety of payment channels, including third-party platforms. These payment channels may be altered at Wildfire’s discretion over time.
All personal information, including account details and top-up records, will be securely managed within the Service. Please ensure that you use the Service in a secure environment to avoid potential losses.
Rules of Conduct/Usage
The Wildfire Service may include various communication channels, such as forums, communities, or chat areas (“Communication Channels”), designed to facilitate interaction between users of the Service. These Communication Channels are provided as part of the Service, and Wildfire reserves the right to modify, manage, control, or terminate all or part of the Communication Channels at its sole discretion. While Wildfire is not obligated to monitor these channels, it reserves the right to review and remove any content at any time, with or without notice.
Wildfire may also suspend or terminate your access to any Communication Channels without prior notice, depending on the rules and Terms governing the channels. You acknowledge that any chats, posts, or materials shared by users on the Communication Channels are not endorsed or controlled by Wildfire, and Wildfire assumes no liability for any activities that occur within these Communication Channels.
You agree that all communications made within the Communication Channels are public, and you should not expect any privacy concerning your use of these channels. Wildfire is not responsible for any information you choose to share or for the actions of other users within the Communication Channels.
You agree to use the Service in a lawful manner and to comply with all usage rules. The following examples, though not exhaustive, illustrate prohibited activities. You agree not to use the Service to:
- Defame, libel, mock, stalk, harass, intimidate, or abuse any individual in a hateful, racial, ethnic, or objectionable manner.
- Post, upload, or distribute content that is obscene, vulgar, pornographic, sexual, or otherwise offensive.
- Impersonate another person or falsely represent yourself as a Wildfire employee or representative.
- Upload or share files containing viruses, Trojan horses, worms, or any other harmful software that may damage the Service or other users’ systems.
- Attempt to obtain personal information, including passwords, from other users.
- Infringe on the intellectual property, personal, or contractual rights of any party, including sharing information that violates copyrights, trademarks, patents, trade secrets, or privacy rights.
- Use the Service for anything other than personal communication, including sending promotional materials, advertisements, chain letters, political campaigns, or engaging in commercial activities.
- Circumvent or interfere with any security features or restrictions related to the use or access of the Wildfire Service.
- Share any real-world personal information about other users within any Wildfire service or associated bulletin board.
- Improperly use support channels or complaint mechanisms to make false reports to Wildfire.
- Develop, distribute, or inform others about “auto” programs, “macro” programs, or any other software designed to cheat or violate applicable License Agreements.
- Violate applicable laws or regulations, or promote illegal activities such as hacking, cracking, or distributing counterfeit software.
- Exploit, share, or inform others about any bugs or errors in the game that provide an unintended advantage.
- Engage in any form of cheating or behavior that Wildfire deems contrary to the spirit of the Service.
User Content
By using technology and tools provided by Wildfire, you agree to willingly publish content on the Service. You understand and agree that without explicit written permission from Wildfire, you may not distribute, sell, transfer, or license this content or application in any manner, in any country, or on any social network or other medium.
Any data, text, graphics, photographs, and their selection and arrangement (referred to as “User Content”) uploaded to the Service may be subject, in whole or in part, to unrestricted commercial, non-commercial, and/or promotional use by Wildfire. User Content, including text, graphics, and photographs, is uploaded by users and remains the sole responsibility of the originator. Therefore, users are accountable for any files they upload, post, or otherwise make available, and Wildfire assumes no responsibility. Wildfire may or may not monitor User Content and does not guarantee its accuracy, quality, or integrity. By using Wildfire, you acknowledge and accept that you may encounter material that you find offensive or objectionable. You agree that Wildfire will not be liable under any circumstances for any User Content, including errors in any User Content or any loss or damage resulting from the use of User Content.
Wildfire reserves the right to remove and permanently delete any User Content from the Service, with or without notice.
Modifying, Suspending, and Terminating Our Services
Wildfire is committed to continually evolving and improving its Services. This may include adding or removing functionalities, features, or even suspending or discontinuing a Service entirely.
- In cases where the Service needs to be suspended due to system maintenance or upgrades, Wildfire will make reasonable efforts to notify users in advance.
- Wildfire retains the right to immediately terminate the Service if there is a violation of social norms, applicable laws, or regulations.
- Wildfire may deactivate accounts that have been inactive for more than 90 consecutive days.
- For violations of Wildfire’s Terms or rules, Wildfire may take corrective actions, including temporary isolation, suspension, deactivation of accounts, or the termination or restriction of access to the Service.
- Except in the cases noted above, Wildfire reserves the right to suspend or terminate all or part of the Service with 15 days’ prior notice. In situations where prior notice is not feasible due to unforeseen circumstances, Wildfire is not liable for any loss experienced by users or any third party resulting from the suspension or termination of the Service.
Disclaimer of Warranty; Limitation of Liability
Wildfire does not guarantee the Service will fully meet your requirements; or the Service will be uninterrupted, timely, secure, or error-free.
You agree that your use of the Service is at your own risk. To the maximum extent permitted by law, Wildfire, its officers, directors, employees, and agents disclaim all warranties, express or implied, regarding the website and your use thereof, including warranties of title, merchantability, fitness for a particular purpose, non-infringement, accuracy, authority, completeness, usefulness, and timeliness.
Wildfire makes no warranties or representations regarding the accuracy or completeness of the Service’s content or the content of any linked medium, and assumes no liability or responsibility for any (i) errors or inaccuracies in content, (ii) personal injury or property damage resulting from your access to and use of the Service, (iii) unauthorized access to or use of our secure servers and/or any personal or financial information stored therein, (iv) interruption or cessation of transmission to or from the Service, (v) bugs, viruses, trojan horses, or similar which may be transmitted to or through the Service by any third party, or (vi) errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Service.
In no event shall Wildfire, its directors, officers, agents, contractors, partners, or employees be liable to you or any third party for any special, direct, indirect, incidental, punitive, or consequential damages whatsoever, including any lost profits or lost data arising from your use of the Service or other materials on, accessed through, or downloaded from the Service, whether based on warranty, contract, tort, or any other legal theory, even if Wildfire has been advised of the possibility of such damages. This limitation of liability applies to the fullest extent permitted by law in the applicable jurisdiction. You acknowledge that Wildfire shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party, and that any risk associated with the foregoing rests entirely with you.
You agree to indemnify and hold Wildfire, its directors, agents, contractors, partners, and employees harmless from and against any loss, liability, claim, demand, damages, costs, and expenses, including reasonable attorney’s fees, arising out of or in connection with (i) your use of and access to the Service, (ii) your violation of these Terms of Service, (iii) your violation of any third-party rights, including without limitation any copyright, property, or privacy right, (iv) any claim that your User Content caused damage to a third party, or (v) any content you post or share on or through the Service.
APPLICABLE LAW AND JURISDICTION
Your use of the Service signifies your agreement that these Terms of Service, along with any disputes or claims arising between you and Wildfire, shall be governed by the laws of the Hong Kong Special Administrative Region, China, without regard to conflict of laws principles or your location. Any dispute, claim, or controversy arising in connection with your use of the Service shall be exclusively decided by a competent court located in the Hong Kong Special Administrative Region, China. You consent to this jurisdiction and waive any defenses regarding lack of personal jurisdiction or inconvenient forum concerning venue and jurisdiction in the Hong Kong Special Administrative Region, China.
Wildfire Interactive Limited retains the right to modify these Terms of Service at any time without prior notice, and it is your responsibility to regularly review them for any changes. Your continued use of Service after any revisions to these Terms of Service indicates your agreement to and acceptance of the updated terms.
You and Wildfire Interactive Limited agree that any claim or dispute arising from or related to the Service must be initiated within two (2) years after the cause of action arises. Otherwise, such claim or dispute is permanently waived.
